§1 Jurisdiction
For all deliveries and services of the American Indian Gallery
these general business terms apply exclusively,
based on the legal regulations of the German Civil Law Code,
latest edition.
§2 Conclusion of contract
All offers from the American Indian Gallery are without obligation.
An Order becomes binding when the dispatch and delivery address, type of payment
and acceptance of the general business terms when "Confirm Order" is clicked by the customer,
who will then receive confirmation by e-mail.
The sales contract comes into operation on receipt of the goods, respectively,
the delivery confirmation by e-mail. For the consumer it includes a right to cancellation
- see §3.
By obvious misleading information in the pricing oder description of the products,
the American Indian Gallery reserves the right to assert this immediately.
All contract data will be stored and can be called up and seen by the customer
under their account at any time.
§3 Right of revocation
You are entitled to revoke your contract within two weeks without reason and in writing (letter, fax, e-mail). The period of
two weeks starts upon receipt of this notice. It is sufficient to send your revocation within the period of two weeks,
i.e. the date of sending the revocation is binding. You may send your revocation to:

Consequences
In case of a valid revocation the mutually received goods, services and payments are to be returned. If you cannot
return the recieved goods and services or can return them only in a reduced quality, you will be liable for compensation of
the loss of value. [In case of surrendered goods a reduction of quality as might be expected if the goods were physically
inspected in a store is acceptable]. You can avoid the liability for loss of value if you treat the goods not like an owner
and refrain from any activity that may reduce the value. Items ready for shipment are to be returned to us at our cost and
risk.
§4 Payment and delivery terms,
dispatch costs
All prices mentioned are inclusive ot the current VAT.
To begin with,
new customers can only pay either cash in advance or COD.
According to the amount and size of the orders we can place them
in another customer group whereby other payment terms are possible.
Deliveries to foreign countries are basically subject to cash in advance.
There is a lump sum payment for dispatch of 9,- Euro.
The invoice is to be settled immediately on receipt of the goods, latest within
30 days thereafter. In the case of a delay, the American Indian Gallery reserves
the right to charge extra reminder costs.
The goods remain the property of the American Indian Gallery until the full
payment including delivery and any further costs have been paid.
The American Indian Gallery is obligated to provide the equivalent service
of the ordered goods both in quality and price.
Details in respect of delivery dates are not binding, if the have not been
explicitly agreed in writing.
All offers are subject only to the corresponding stock.
The American Indian Gallery reserves the right not to deliver the goods
and withdraw from the contract, if the supplier cannot deliver the ordered goods.
§5 Defects and guarantee
The reproduction of the jewellery is exemplary, however it could be that there are
slight differences to shape and colour. This is not a defect.
With defective goods, we reserve the right to eliminate the defect or provide a replacement.
Should this be excessive or impossible, then the customer has the right to withdraw from the contract
and to return the goods by registered post to the above mentioned address, or to reduce the purchase
price. Noted defects are to be communicated immediately.
The guarantee period is 24 months and begins when the customer, as ultimate customer,
receives the goods. For trading customers, the guarantee period is 12 months.
§6 Privacy and data protection
The protection of privacy and personal data
of our customers is very important to us.
Here following are some notes in accordance with
the Federal Data Protection Law (BDSG) and the
Tele Service Data Protection Law (TDDSG).
All pages under
http://www.american-indian-gallery.de can be
viewed anonymously.
However, to deal with an order, the American
Indian Gallery requires certain personal
information, such as the postal address and the
e-mail address. These are necessary to send the
goods and to keep the customer informed about the
current order. Each customer can always delete his account.
The data of our customers is used exclusively for
the purpose mentioned and is not passed on to
another unauthorized third party.
